Joe Biden released a series of anti-gun proposals yesterday which would make anyone with a topical understanding of either firearms or civics roll their eyes. That Biden is insane and once claimed people should fire a shotgun through the door to stop home invaders has been entirely glossed over by people who still support him. The support base is rather small, and shrinking, but somehow still exists despite near double digit inflation, lax border policies, skyrocketing crime, and various diplomatic issues. The White House has even resorted to taking credit for using military intervention to alleviate an entirely self-inflicted infant formula shortage.
Here we will examine the proposals. Are they lawful? Pragmatic? Complete nonsense?
1. Ban assault weapons — and if we can’t, then we should raise the age to purchase them from 18 to 21.
Such a ban was attempted under the Clinton administration. It had no impact at all on gun crime. Indeed, gun crime rose and peaked under the ban. Raising the age to purchase "assault" weapons implicitly violates the 14th amendment by relegating 18-20 year olds- who are old enough to enlist in the military as well as vote and bear arms generally- to second class status, reducing their ability to participate as civilian militia despite explicitly being a part of it.
2. Ban high-capacity magazines
There is no such thing as a high capacity magazine. One could reasonably argue that anything shy of a 15-round magazine is, rather, "low capacity". For some weapons this would be a de facto ban on their very existence as no low capacity magazine even exists for them. Some of them are among the most popular handguns in the nation. This would have absolutely no impact on the sporting rifles most commonly demonized by liberals, but would oddly impact even some low-caliber handguns.
3. Strengthen background checks
While this proposal has wide support among the population, it would not have stopped the Uvalde shooting being used as an excuse for the current anti-self defense pogrom, and is self evidently nonsensical- most guns used in crime are either legally purchased (and subject to a background check already) or involve organized crime; organized criminals tend not to abide by the law.
4. Enact safe storage laws and red flag laws
Safe storage laws nullify the very premise of the use of firearms for home defense because the reaction time needed to utilize them is increased beyond reason. Such laws are also unenforcable unless one imagines heavily armed police entering tens of millions of US homes regularly to spot-check whether firearms are then currently stored "safely." Red flag laws are absolutely unconstitutional- especially when extended to the federal level- violating the right to a fair trial.
5. Repeal gun manufacturers’ immunity from liability
Not even in the darkest fever dream would any sane person in congress in a district or state with a significant gun manufacturing industry consider supporting such a measure, since it would inevitably bankrupt the company, destroying enormous amounts of jobs. One could save more lives by recommending such legislation be applied to automobile manufacturers- and it wouldn't even explicitly countermand several constitutional amendments.
Reasonable suggestions such as encouraging teachers to carry firearms, an increase to mental health funding, and abolishing all federal gun control so the militia can slowly weed out violent criminals- are all notably absent from this list. Republicans are currently "negotiating" the issue with their counterparts- let's just hope that they are only pretending to do so and ultimately pass on yet another layer of unconstitutional and useless legalism designed to bereave lawful members of the civilian militia of their arms.
Not to mention that New York, California, and Chicago have these restrictions in place. Do we really want to follow their example given their track record on crime?
Personally, I think this pivot to gun-control discussion isn't to actually advance gun-control at the federal level or advance it in states. This pivot is to reinforce the existing gun-control measures in the states and cities. We should take the opportunity to call out existing gun-control's failure to prevent violence. We should enable the citizenry to prevent violence.
You shouldn't need a license for self defense because there is no license to commit murder.
This is not being done to keep you safe. This is being done, because they want to do something to you, that you would shoot them for.
